By visiting our website, creating an account, submitting customization material, or purchasing a product, you agree to be bound by these Terms of Service. If you do not agree, you may not access the website or use our services.

These Terms apply to all visitors and customers, including browsers, purchasers, contributors of content, and anyone submitting a custom design.

1. Online Store Terms

By agreeing to these Terms, you confirm that you have reached the age of majority where you live or have permission from a parent or legal guardian to use this website.

You may not use our products or services for an unlawful or unauthorized purpose. You must not transmit viruses, malicious code, or anything intended to damage or interfere with the website.

A violation of these Terms may result in the suspension or termination of your access to our services.

2. Products and Availability

Broad Marketplace sells quality clothing and may offer customized, personalized, printed, or made-to-order products.

We make reasonable efforts to display product colours, designs, measurements, and images accurately. However, colours may appear differently depending on your screen, and minor variations may occur during printing or production.

Product availability, colours, sizes, styles, and quantities may change without notice. We may limit or discontinue products at any time.

We do not guarantee that every product, colour, or size will remain available after an order is placed. If an item becomes unavailable, we may offer a replacement, store credit, or refund for the unavailable item.

3. Custom and Personalized Orders

Customers are responsible for reviewing all names, wording, dates, sizes, colours, images, and other customization details before submitting an order.

Customized products may enter production shortly after purchase. Once production begins, an order may not be changed, cancelled, returned, or refunded unless the item arrives damaged, defective, or different from the approved order.

Broad Marketplace is not responsible for spelling errors, incorrect information, poor-quality images, or other mistakes submitted or approved by the customer.

We may refuse customization requests containing unlawful, hateful, threatening, discriminatory, misleading, or otherwise inappropriate material.

4. Customer-Submitted Content

When you submit text, artwork, photographs, logos, or other content for customization, you confirm that:

• You own the content or have permission to use it.

• The content does not violate another person’s copyright, trademark, privacy, publicity, or other rights.

• The content does not violate any law.

• Broad Marketplace may reproduce and use the content as necessary to create and fulfill your order.

You retain ownership of your original content. You grant Broad Marketplace and its production partners a limited licence to use, reproduce, modify, and transmit that content solely as needed to process, manufacture, and deliver your order.

You are responsible for claims resulting from content you submit without the required rights or permission.

5. Orders

Submitting an order does not guarantee acceptance. We reserve the right to refuse or cancel an order for reasons including:

• Product unavailability

• Suspected fraud or unauthorized activity

• Incorrect pricing or product information

• An undeliverable location

• A violation of these Terms

• Inappropriate or unlawful customization content

If we cancel an order after payment has been processed, we will refund the cancelled amount to the original payment method.

6. Pricing and Payment

Prices are displayed in Canadian dollars unless otherwise stated. Prices, promotions, discounts, and product availability may change without notice.

Applicable taxes and shipping charges are calculated and displayed during checkout when possible.

You agree to provide complete, current, and accurate billing and payment information. You authorize us and our payment providers to charge the total amount displayed at checkout.

If a pricing or listing error occurs, we may cancel the affected order and issue a refund.

Discount codes cannot be applied after an order is placed unless required by law or expressly approved by Broad Marketplace.

7. Shipping and Delivery

Processing and delivery estimates are provided for convenience and are not guaranteed. Production or delivery may be affected by carrier delays, customs, weather, holidays, inventory issues, or circumstances outside our reasonable control.

Customers are responsible for entering a complete and accurate shipping address. Additional costs may apply when an order must be reproduced or resent because the customer provided incorrect information.

Some orders may arrive in separate packages because products can be fulfilled by different production facilities.

8. Returns, Refunds and Exchanges

Returns, refunds, exchanges, and cancellations are governed by our Refund and Return Policy.

Because customized and made-to-order products are produced specifically for each customer, they generally cannot be returned or exchanged due to:

• Ordering the wrong size or colour

• Changing your mind

• Incorrect customization information submitted by the customer

• Minor colour differences between a screen and the finished product

Nothing in these Terms limits any rights or remedies that cannot legally be excluded under applicable consumer-protection laws.

9. Damaged, Defective or Incorrect Products

If you receive a damaged, defective, or incorrect item, contact us within  14 days of delivery at  HELLO@BROADMARKETPLACE.COM.

Include your order number, a description of the problem, and clear photographs showing the item and packaging. We may offer a replacement, refund, or another appropriate solution after reviewing the claim.

Do not return an item before receiving instructions from us.

10. Accuracy of Website Information

We aim to keep product descriptions, prices, photographs, availability, and other website content accurate. However, information may occasionally contain errors, omissions, or outdated details.

We may correct errors, update information, or cancel affected orders at any time, including after an order has been submitted. If a paid order is cancelled, the appropriate amount will be refunded.

11. Intellectual Property

Unless otherwise stated, the Broad Marketplace name, branding, website content, product photographs, graphics, designs, text, and other original materials belong to Broad Marketplace or are used under licence.

You may not copy, reproduce, distribute, sell, modify, or commercially exploit our content without written permission.

Purchasing a product does not transfer ownership of the design, artwork, trademark, or other intellectual property appearing on it.

12. Customer Reviews and Feedback

If you submit a review, comment, suggestion, photograph, or other feedback, you grant Broad Marketplace a non-exclusive, worldwide, royalty-free licence to display, reproduce, edit, and use that content for store operations and marketing, subject to applicable law.

You confirm that your submission is truthful, based on your genuine experience, and does not violate another person’s rights.

We may remove content that is unlawful, abusive, misleading, offensive, or unrelated to the product or service.

13. Third-Party Services

Our store is hosted by Shopify and may use third-party payment processors, production partners, shipping carriers, applications, or service providers.

Third-party services may be governed by their own terms and privacy policies. Broad Marketplace is not responsible for third-party websites, services, content, or conduct beyond what applicable law requires.

Shopify provides the ecommerce platform but is not the seller of Broad Marketplace products and is not responsible for fulfilling customer orders.

Broad Marketplace uses AI tools to create and enhance store imagery and content.

14. Privacy

Your submission of personal information through the store is governed by our Privacy Policy.

By using the website, you acknowledge that information may be processed by Shopify and other service providers involved in payments, production, shipping, fraud prevention, analytics, and store operations.

15. Prohibited Uses

You may not use the website or its content:

• For unlawful, fraudulent, or misleading purposes

• To violate intellectual-property or privacy rights

• To harass, threaten, abuse, or discriminate against others

• To submit false information

• To distribute viruses or malicious code

• To collect information about others without authorization

• To interfere with the website’s security or operation

16. Disclaimer of Warranties

Any dispute will be handled by the courts located in Kelowna, BC, Canada, unless applicable consumer law requires otherwise.
